I understand and accept that the Indoor Skydiving Activities (the use of any equipment or participation in any Indoor Skydiving Activities) involves significant inherent physical risks, including but not limited to falls, loss of control, collisions, disorientation, equipment malfunction, and other hazards that may result in serious injury or death. By purchasing a ticket and/or accessing and participating in the Indoor Skydiving Activities, I freely and voluntarily choose (i) to participate in the Indoor Skydiving Activities provided by Vertical Drops Trading (Pty) Ltd, trading as The Drop at my own risk; and (ii) to use all the equipment provided by Vertical Drops Trading (Pty) Ltd, trading as The Drop at my own risk, and in doing so I fully assume all risks that may arise or be associated with the Indoor Skydiving Activities.
I acknowledge and agree that Vertical Drops Trading (Pty) Ltd, trading as The Drop does not provide any warranties (whether express, tacit or implied) as to the quality, safety, fitness for purpose or condition of the Indoor Skydiving Activities and the equipment used for the Indoor Skydiving Activities;
I acknowledge and agree that Vertical Drops Trading (Pty) Ltd, trading as The Drop, its owners, directors, employees, contractors, agents, and affiliates ("The Drop Relevant Parties") shall not be liable for any injury, illness, damage, loss, death, or other claim whether direct or indirect, arising from the use of or participation in the Indoor Skydiving Activities, to the maximum extent allowed under South African law; and
I hereby waive, release, discharge, and hold harmless Vertical Drops Trading (Pty) Ltd, trading as The Drop, and each of The Drop Relevant Parties from any and all claims or causes of action arising from injury, illness, damage, loss, death, or other claim whether direct or indirect, arising from your use of or participation in the Indoor Skydiving Activities, whether caused by negligence or otherwise, to the maximum extent allowed under South African law.
By purchasing a ticket and/or being granted access the Indoor Skydiving Activities, I hereby agree to fully indemnify and hold harmless Vertical Drops Trading (Pty) Ltd, trading as The Drop and each of The Drop Relevant Parties from any claims, actions, liabilities, loss, costs or damages (including without limitation claims brought by third parties and legal fees on an attorney and own-client basis) arising from or in connection with:
the Participant's own conduct or participation in the Indoor Skydiving Activities;
the conduct or participation of another Participant participating in the Indoor Skydiving Activities;
a breach of any of the terms and conditions set out herein or as otherwise incorporated or provided by Vertical Drops Trading (Pty) Ltd, trading as The Drop;
any misrepresentations made during the booking process to access the Indoor Skydiving Activities.,
I understand that in order to access and participate in the Indoor Skydiving Activities, the Participant must be in good physical and mental health and must not suffer from any condition that may be worsened by any physical activity, including but without limitation, pregnancy, injury, pre-existing medical conditions, pains and ailments. If the Participant is uncertain as to their meeting of this requirement, they are required to seek medical advice to ensure their good health for participation in the Indoor Skydiving Activities. I hereby acknowledge and agree that:
• Vertical Drops Trading (Pty) Ltd, trading as The Drop reserves the right to refuse entry or participation for any safety reason/s;
• In the case of injury, Vertical Drops Trading (Pty) Ltd, trading as The Drop may arrange for emergency medical treatment or ambulance facilities on the basis that the costs of such treatments, services and facilities shall be for the account of the Participant. Any refusal by the Participant of any such medical and emergency treatment / services shall not be the liability of Vertical Drops Trading (Pty) Ltd, trading as The Drop.
I hereby warrant and certify that the Participant is in good physical and mental health, and that:
the Participant does not suffer from any medical condition that may affect his/her ability to safely participate in the Indoor Skydiving Activities;
the Participant is not pregnant, nor does the participant have recent injuries or surgeries;
the Participant does not have any heart, neck, back, joint or other bodily conditions that could be aggravated or place the Participant at risk by participating in the Indoor Skydiving Activities;
the Participant is not under the influence of drugs, alcohol, medication, or other impairing substances;
the Participant does not suffer from recurring or previous shoulder dislocation or other joint dislocation; and
the Participant complies with the height and weight restrictions for participation as communicated by the instructor or at the venue.
The Participant agrees to:
Follow all instructions given by instructors or staff, and as presented at the venue;
Wear all required equipment correctly, as demonstrated by the instructors or staff;
Immediately report any discomfort or unsafe conditions;
Refrain from any reckless or non-compliant behavior;
The Participant hereby confirms that he/she understands that the Participant's failure to comply with the safety rules and protocols of the Vertical Drops Trading (Pty) Ltd, trading as The Drop may result in the Participant's removal from the Indoor Skydiving Activities and venue without refund.
I give permission for the Vertical Drops Trading (Pty) Ltd, trading as The Drop to photograph, record, or film the Participant's participation and to use the Participant's image, video, or likeness for promotional, security, training or commercial purposes, without any compensation. I hereby (i) irrevocably grant permission for the Vertical Drops Trading (Pty) Ltd, trading as The Drop to create and use any such content created without any compensation to me or the Participant; and (ii) confirm that neither I nor the Participant has any expectation of compensation.
States the minimum age to participate is 4 years. Participants under 18 require a parent or legal guardian to sign the form, agreeing to all terms and assuming full responsibility for the minor's participation.
If a booking to participate in the Indoor Skydiving Activities is made by one person on behalf of another person/s or group, the person acquiring the booking and signing this form confirms it is the authorised agent for each of the persons for whom tickets are being purchased and that they accept these terms and conditions. In this instance, any such authorised agent hereby warrants, by their signature hereto, that they have obtained the full consent of the Participants for whom booking is being made, and indemnifies Vertical Drops Trading (Pty) Ltd, trading as The Drop and each of The Drop Relevant Parties against any claim arising from such bookings.
This agreement and the terms and conditions contained herein shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of Gauteng Province of the Republic of South Africa.
Per section 49 of the Consumer Protection Act, the Participant and signatory are notified that:
the terms and conditions contained herein limit the liability of Vertical Drops Trading (Pty) Ltd, trading as The Drop and each of The Drop Relevant Parties;
the Participant (and their signing legal guardian, if the Participant is a minor) waives certain legal rights and assumes significant risk;
the Participant (and their signing legal guardian, if the Participant is a minor) is indemnifying Vertical Drops Trading (Pty) Ltd, trading as The Drop and each of The Drop Relevant Parties from claims; and
by your signature you confirm that you understand and accept each of the terms and conditions set out in this document.
By signing below, I confirm that:
I have read and understood the entire document and all the terms and conditions herein, as well as all terms and conditions of use / participation as presented at the venue
I voluntarily agree to all its terms and conditions, as well as all terms and conditions of use / participation as presented at the venue.
I understand that I am agreeing to terms and conditions affecting my legal rights. I understand and consent to the fact that I am waiving my legal rights and indemnifying Vertical Drops Trading (Pty) Ltd, trading as The Drop and each of The Drop Relevant Parties from claims.
I am signing freely and without pressure.
